Terms and conditions

CLAUSE 1: APPLICABILITY OF THE GENERAL SALE CONDITIONS

Ordering a product on the sensenprovence.com site implies full and complete acceptance by the Customer of these general sale conditions, excluding any other documents, such as prospectuses or catalogues, issued by Sens en Provence - Vinalie or by any of its partner service providers, which are only of indicative value.
None of the Customer's special conditions may take precedence over these general conditions unless formally accepted in writing by Sens en Provence - Vinalie. Unless specifically accepted, any contrary condition cannot therefore be raised against Sens en Provence - Vinalie, regardless of when it may have been brought to its knowledge.
Sens en Provence - Vinalie shall be entitled to make amendments at any time to these general sale conditions. The applicable general conditions shall be those in force at the date on which the order is received.
The fact that Sens en Provence - Vinalie does not, at a given moment, rely upon any of these general sale conditions shall not be interpreted as a waiver of the right subsequently to rely thereon.
Sens en Provence - Vinalie shall not be committed to carry out any order until after it has accepted the Customer's order, confirmed by an email sent to the Customer.

CLAUSE 2: PRODUCTS AVAILABLE ON WWW.SENSENPROVENCE.COM

The products are offered subject to stock availability at the date on which the order is accepted.
Pursuant to Section L. 111 1 of the French Consumers' Code, the Purchaser may, at the time of his order, take note, on the sensenprovence.com website, of the essential features of the products that he wishes to order.
Sens en Provence - Vinalie's product catalogue is subject to constant change.

CLAUSE 3: APPLICABLE PRICES

The prices on the www.sensenprovence.com website are expressed in Euros per item, all taxes included, and are the tariff in force on the date of the order.
They do not include shipment expenses, which are invoiced in addition to the price of the products purchased in accordance with the amount of the order. The shipment expenses shall be indicated before the Purchaser's order is recorded.
In all cases, the dates shown on invoices shall be the dates on which the goods are sent.
Catalogue prices are given with all taxes included and by way of indication. They may be changed at any time in accordance with market developments and the availability of the products and services desired by the Customer.
Sens en Provence - Vinalie only guarantees the price to the Purchaser as at the date on which the order is confirmed.

CLAUSE 4: PAYMENT

Payment shall be made at the time of the online order by the Purchaser. Sums paid shall not at any time be regarded as deposits or advance payments.
All orders shall be payable in Euros, all taxes and obligatory contributions included. Any bank charges (such as exchange rate commission) shall be the Purchaser's responsibility (including in the event of a repayment).
The Purchaser guarantees to Sens en Provence - Vinalie that he has the necessary authorizations to use the payment method chosen for his order at the time when his order form is recorded.
Sens en Provence - Vinalie reserves the right to suspend or cancel any performance of an order and/or delivery, regardless of its nature and level of performance, in the event of default in payment or part payment of any sum which may be payable by the Purchaser, in the event of payment problems or in the event of fraud or attempted fraud relating to the use of the sensenprovence.com website.
Penalties shall automatically apply to any sums remaining unpaid ten days after the payment date or on notification of refusal of bank payment. Delivery of any new order may be suspended in the event of delay in payment or part payment of a previous order, notwithstanding these provisions.
Sens en Provence - Vinalie reserves the right to request a photocopy of the Purchaser's identity card and/or, if applicable, credit card (front only) for any payment by credit card.
As part of the fight against Internet fraud, information relating to your order may be sent to any third party authorized by law or designated by Sens en Provence - Vinalie for the sole purpose of verifying the Purchaser's identification, the validity of the order, the type of payment used and the delivery intended.
Sens en Provence - Vinalie shall retain full and complete ownership of the products sold until the full price has been received.

CLAUSE 5: DELIVERY

Procedure

Delivery shall take place at the location noted by the Purchaser on the sensenprovence.com website.
If the Customer refuses or fails to take delivery of the product ordered or if delivery cannot be carried out because of incorrect or incomplete details given by the Purchaser, Sens en Provence - Vinalie shall be entitled to claim immediate payment in full of all additional expenses resulting from the refusal or failure to accept the said delivery.
Purchase invoices shall be sent by email to the email address indicated by the Purchaser on the sensenprovence.com website.
Carriage of the products sold by Sens en Provence - Vinalie shall in all cases be at the Customer's risk, and it shall be the Customer's responsibility to make any claim in accordance with the provisions of Clause 6 below.

Time limits

Deliveries shall be subject to product availability and shall be made in the order in which orders arrive.
Sens en Provence - Vinalie shall not be held responsible or liable for penalties for delay or for compensation, of any kind whatsoever, in the event of late delivery or non-delivery of the products and/or services in circumstances outside its control.
The delivery time limits, following validation of your order on the terms referred to in these general sale conditions, shall be as follows:

  • post: 10 working days or less (except in French overseas departments and territories, see the post office delivery conditions)
  • Chronopost: dependent on the country, see Chronopost time limits

If these time limits are exceeded by 7 days, other than because of a force majeure event, the Purchaser shall have the option of cancelling his order by recorded-delivery letter with request for acknowledgment of receipt, sent to the following address:

Sens en Provence - Vinalie shall then make enquiries with the carrier before making any repayment for the products which have been ordered and not delivered.
The Purchaser may request the cancellation of his order for failure to deliver within the contractual period, within a maximum period of sixty working days from when the maximum period indicated for the delivery of the products has been exceeded. If the order is returned in full, all the sums paid by the Purchaser shall then be returned to him in the form of a credit note or as a repayment, at the Purchaser's option, as soon as possible and no later than thirty days after the date on which the Purchaser exercised his right to have his order cancelled.

CLAUSE 6: ACCEPTANCE OF THE PRODUCTS

Any reservations on the delivery of a product must be brought to the attention of Sens en Provence - Vinalie by email, fax or recorded-delivery letter within three (3) days.
It shall be the Customer's responsibility to supply any evidence to prove the defects or anomalies noted.
In the event of an apparent defect or non-conformity of the delivered product, duly confirmed by Sens en Provence - Vinalie, the Customer may obtain a replacement, free of charge, or repayment for the product, at Sens en Provence - Vinalie's option, to the exclusion of any damages or any other compensation of any kind whatsoever.

Delivery by post (Metropolitan France and French overseas departments and territories)

Where it has not been possible to deliver the package if the letterbox is too small or the Purchaser is not present, the Purchaser shall receive notice of attempted delivery. This notice shall enable him to recover his package from the designated post office within fifteen days. After this period, the package shall be returned to the sender.
No dispute relating to the delivery itself shall be possible if the package appears to have been delivered; the French Post Office computer system (computer to film) shall constitute proof.
If the Purchaser notices a package anomaly (package open or damaged) he must not open it and must return it to the post office within five days in order to make a "damage report". Opening the package prevents any possibility of recourse against the post office.
The Purchaser must notify Sens en Provence - Vinalie of the problem encountered by calling the following telephone number: +33 (0)4 94 85 94 94.
If the Purchaser notices an anomaly regarding the content of the package (product missing or damaged, etc.), the Purchaser or the recipient of the products ordered must notify Sens en Provence - Vinalie of this anomaly by calling the following telephone number: +33 (0)4 94 85 94 94. Any reservations regarding the delivery of a product must be brought to Sens en Provence - Vinalie's attention by email, fax or recorded-delivery letter within three (3) days.

Delivery by carrier (Customer Europe and professionals)

On delivery, the Purchaser or recipient of the products ordered shall be supplied with an acknowledgment of receipt by the TNT or other agent, which he shall sign electronically.
If the Purchaser or recipient of the product order is not present, he shall be given a notice of attempted delivery, enabling him to make contact with the carrier at the address shown on the notice of attempted delivery in order to agree another delivery date.
If the Purchaser notices an anomaly in the package (package open or damaged), he must make observations on the carrier's form.
If the Purchaser notices an anomaly regarding the content of the package (product missing or damaged, etc.), the Purchaser or the recipient of the products ordered must notify Sens en Provence - Vinalie of this anomaly by calling the following telephone number: +33 (0)4 94 85 94 94. Any reservations regarding the delivery of a product must be brought to Sens en Provence - Vinalie's attention by email, fax or recorded-delivery letter within three (3) days.

CLAUSE 7: RIGHT OF CANCELLATION AND RELEVANT TIME LIMIT

In accordance with section L. 121 20 of the French Consumers' Code, the Purchaser shall have seven days from the date of receipt of his order within which to return the order in full, at his expense, and obtain repayment for the amount of the order.
The goods must be returned to Sens en Provence - Vinalie in accordance with the procedure referred to in Clause 8 below.

CLAUSE 8: RETURN OF THE PRODUCTS

Products which have been delivered must be returned by the Purchaser to Sens en Provence - Vinalie in accordance with the following instructions. The products absolutely must be returned to Sens en Provence - Vinalie in their original condition (packaging, accessories, notice, etc.) accompanied by a letter signed by the Purchaser. Sens en Provence - Vinalie shall accept returns within fourteen days from the date of receipt of the order.
The costs of carriage for the return of the package shall be payable by the Purchaser except in the event of non-conformity of the order.
If the Purchaser wishes to exchange products which have been ordered, he shall be responsible for the delivery costs.
In order to return a product, it is essential that the following instructions be followed:

  1. Use the original packaging to return the product(s).
  2. Complete and attach a return letter stating the reasons for the return. Returns without a return form shall not be accepted.
  3. Send the package by recorded-delivery letter with acknowledgment of receipt to the following address: Sens en Provence - Château Roubine, 4216 route de Draguignan - 83510 Lorgues - FRANCE

Sens en Provence - Vinalie does not accept packages on which postage is payable. Any risk connected with the return of the product shall be borne by the Purchaser.

CLAUSE 9: LAW REGARDING PERSONAL DETAILS

Personal details obtained by Sens en Provence - Vinalie shall not be transferred to third parties.
The Purchaser has a right to access and to rectify personal data relating to him, by ordinary request sent to Sens en Provence - Vinalie at the following address:

The Customer agrees to receive promotional offers from Sens en Provence - Vinalie by email.

CLAUSE 10: APPLICABLE LAW AND COMPETENT COURTS

French law alone shall be applicable to these general sale conditions.
Any proceedings of any kind whatsoever, as well as any dispute relating to the formation or performance of the order or to these general sale conditions shall be submitted to the competent courts of Grasse, to which jurisdiction is specifically allocated.
This clause shall also apply in the event of interlocutory proceedings, counter claims, a plurality of defendants or third party proceedings, regardless of the method and procedure for payments, and no clauses which may exist in the Customer's general conditions shall prevent the application of these provisions.
